Give to the Ocean. Keep More of What You Earn.
A gift to an ocean charity can lower your federal and California taxes. Here is how it works in 2026: the new deduction for people who don't itemize, the new floor for those who do, and why gifts of stock and IRA distributions often do the most good for the least cost.

The Tax Break Is the Bonus. The Ocean Is the Point.
Scientists estimate that roughly half of Earth's oxygen comes from the ocean (NOAA), and aquatic foods supply at least a fifth of the animal protein eaten by more than three billion people (FAO). On the Southern California coast, giant kelp can grow up to two feet a day. Yet plenty of young people in Orange County have grown up minutes from that coast without ever going out on it.
My Clean Ocean, a Newport Beach 501(c)(3), puts kids from underserved communities in the water: boat days into the kelp, professional underwater cameras, dive training, mentors, and a path toward real careers in ocean science and media. No child or family ever pays, and 100% of net donations fund the youth programs.
The tax code rewards that kind of giving, and the rules changed for 2026. Used well, they can turn a gift you were already planning into a larger one, at a lower cost to you. The sections below explain how.
The New Rules, Plainly
$1,000 single · $2,000 joint
Starting with 2026 returns, cash gifts straight to a public charity are deductible on top of the standard deduction. Donor-advised fund contributions don't qualify, and the cap isn't indexed for inflation.
A 0.5% floor
Only giving above 0.5% of your AGI counts. With $200,000 of AGI, the first $1,000 isn't deductible. Many donors bunch two years of giving into one to clear the floor.
Capped at 35¢ per dollar
For the 37% bracket, each dollar of itemized deductions is worth at most 35 cents.
60% of AGI for cash, made permanent
Cash to public charities stays deductible up to 60% of AGI (30% for appreciated stock), and any excess carries forward for five years.
Its own rules
California doesn't adopt the non-itemizer deduction, the 0.5% floor or the 35% cap, and lets you itemize on Form 540 even if you take the federal standard deduction.
Four Ways to Give, and What Each Does for Your Taxes
The simplest gift
Deductible up to $1,000/$2,000 even without itemizing in 2026, or in full above the 0.5% floor if you itemize. A receipt arrives the moment it clears; monthly gifts get one per charge.
Often the most efficient
Give shares held over a year: you deduct full market value and never pay capital gains tax on the growth. That matters even more in California, which taxes gains as ordinary income. Email donate@mycleanocean.org for transfer instructions.
Age 70½ and up
Up to $111,000 in 2026 sent directly from your IRA to the charity is left out of your taxable income and counts toward your required minimum distribution, whether or not you itemize.
Free pickup in SoCal
Boats, engines, trailers, dive and camera gear. The deduction follows IRS Publication 4303, and we send Form 1098-C for vessels over $500.
What a Gift Can Cost You After Taxes
Gives $1,000
Deducts the full $1,000 on the 2026 federal return on top of the standard deduction. In the 22% bracket that's $220 less tax, so the gift costs about $780. Given before December 1, the match turns it into $2,000: twenty kids on the boat.
Gives $10,000
The first $1,500 (0.5% of AGI) doesn't count federally, so $8,500 is deducted: about $2,040 saved in the 24% bracket. On the California return the full $10,000 is itemized: about $930 at 9.3%. Net cost is roughly $7,030.
Shares bought for $4,000, now worth $10,000
Deducts the $10,000 market value (above the floor) and never pays tax on the $6,000 gain: about $900 of federal capital gains tax and about $560 of California tax avoided, on top of the deduction.
Ocean Giving and Taxes, Answered
Are donations to ocean conservation tax deductible?
Yes, when the organization is a 501(c)(3) public charity. My Clean Ocean is one (EIN 41-4167030, public charity under section 509(a)(2)), so gifts of cash, stock, IRA distributions, boats and equipment are deductible to the extent the law allows. Check any charity's status in the IRS Tax Exempt Organization Search before you give.
Can I deduct a donation if I don't itemize?
Starting with 2026 returns, yes. Taxpayers who take the standard deduction can deduct up to $1,000 of cash gifts to public charities ($2,000 on a joint return) on top of the standard deduction. It covers cash, check and card gifts made directly to the charity, not gifts to donor-advised funds, and the amount is not indexed for inflation.
What changed for people who itemize in 2026?
Two things. Only the part of your charitable giving above 0.5% of your adjusted gross income is deductible (with $200,000 of AGI, the first $1,000 of gifts does not count), and for the top 37% bracket the benefit of itemized deductions is capped at 35 cents per dollar. The 60%-of-AGI ceiling for cash gifts to public charities was made permanent, and anything above it carries forward up to five years.
Is it better to donate stock than cash?
Often, if you itemize. Give shares you have held more than one year and you deduct their full market value while never paying capital gains tax on the growth. In California, where capital gains are taxed as ordinary income, that avoided tax is large. Gifts of appreciated stock to public charities are deductible up to 30% of AGI. Shares that have lost value are better sold first: you take the loss, then give the cash.
How does an IRA qualified charitable distribution work?
If you are 70½ or older you can have your IRA custodian send up to $111,000 in 2026 directly to a charity. The distribution is excluded from your taxable income, counts toward your required minimum distribution once you are 73, and works whether or not you itemize. You do not also deduct it. Ask the custodian to make the check payable to My Clean Ocean, EIN 41-4167030, and to tell us it is a QCD so we acknowledge it correctly.
What receipt do I need?
For any cash gift, a bank or card record or a written receipt from the charity. For a single gift of $250 or more, the IRS requires a written acknowledgment from the charity stating the amount and whether you received anything in return, and you need it by the time you file. My Clean Ocean emails an acknowledgment and a PDF receipt for every gift the moment it clears.
Does the matching gift double my deduction?
No. You deduct what you give; the match is the matcher's own gift. What the match doubles is the impact: through December 1, Javier matches every gift to My Clean Ocean dollar for dollar, so $100 puts two kids on the boat instead of one. Employer matching works the same way.
What about donating a boat?
A donated boat is deductible, and the IRS rules (Publication 4303) depend on what the charity does with it: if it is sold you deduct the gross sale price reported on Form 1098-C; if it goes into the charity's program you may deduct fair market value. Claims over $500 need Form 8283, and a fair-market-value claim over $5,000 needs a qualified appraisal. Our Donate a Boat page covers pickup and paperwork.
How does California treat charitable gifts?
California sets its own rules. The Franchise Tax Board says California does not adopt the new federal $1,000/$2,000 deduction for non-itemizers, the 0.5% floor, or the 35% limit. On your California return the charitable deduction comes through itemizing, and California lets you itemize on Form 540 even if you take the standard deduction on your federal return, which is common because California's standard deduction is small.
When do I have to give for it to count this year?
By December 31. A card gift counts on the day it is charged, a mailed check on the day it is postmarked, and stock on the day it lands in the charity's account, so start stock transfers and QCDs a few weeks before year end.
Do monthly gifts count?
Yes. Each monthly gift is its own deductible contribution, and each one gets its own receipt. For tax purposes your total for the year is the sum of the monthly charges.
